Agreement governing use of Mechnxx services

By placing an order with Mechnaxx or using our website, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. About Mechnaxx

Mechnaxx is a commercial supplier of industrial chippers and heavy machinery. Our services are intended for business and commercial use. We reserve the right to decline orders from individuals who do not meet our commercial buyer requirements.

2. Account Registration

Certain features of our platform require account registration. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized access.

3. Orders and Contracts

  • All orders are subject to availability confirmation
  • An order becomes a binding contract upon our written acceptance (order confirmation email)
  • Mechnaxx reserves the right to cancel orders due to pricing errors, stock unavailability, or suspected fraud
  • Specifications, prices, and lead times are subject to change without prior notice

4. Pricing and Payment

All prices are listed in USD and are exclusive of applicable taxes, freight charges, and import duties unless stated otherwise. Full payment or approved credit terms are required before equipment ships. We accept wire transfer, ACH, and major credit cards for orders under $50,000. For larger orders, we require bank wire transfer.

5. Title and Risk

Title to equipment passes to the buyer upon full receipt of payment. Risk of loss transfers to the buyer upon handover to the freight carrier (FOB origin), unless otherwise specified in writing.

6. Intellectual Property

All content on the Mechnaxx website — including product images, descriptions, logos, and technical documents — is the property of Mechnaxx or our suppliers. You may not reproduce, distribute, or use this content without written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Mechnaxx’s liability for any claim arising from a transaction shall not exceed the purchase price of the specific equipment in question. We are not liable for indirect, consequential, incidental, or punitive damages.

8. Safe Use and Compliance

Industrial chippers and heavy machinery present serious safety hazards. Buyers are solely responsible for ensuring equipment is operated by trained personnel, in compliance with all applicable federal, state, and local safety regulations (OSHA, ANSI, etc.), and with all manufacturer-required protective equipment in place. Mechnaxx accepts no liability for injuries or damages resulting from improper operation, unauthorized modifications, or non-compliant use.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles. Any disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association’s commercial rules.

10. Changes to Terms

Mechnaxx may update these Terms at any time. The most current version will always be available on this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
